29 CFR  1910.95(c)(1):  The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) Facility  An employee (not provided a 2020 and 2021 audiometric exam) operating the screw machine was exposed to continuous noise levels that were equivalent to 107.4% of the allowable dose of 40% for a 10 hour time weighted average. Exposures equivalent to a 10 hour Time Weighted Average of 90.5 dBA exceeded the Action Level of 83.4 dBA. The sample time was 571 minutes. Zero exposure was assumed for the unsampled time period of 55 minutes.  An employee (not provided a 2020 and 2021 audiometric exam) operating the punch press was exposed to continuous noise levels that were equivalent to  92.9% of the allowable dose of 50% for 8 hour time weighted average. Exposures equivalent to an 8 hour Time Weighted Average of 89.4 dBA exceeded the Action Level of 85 dBA.  The sample time was 392 minutes.  Zero exposure was assumed for the unsampled time period of 88 minutes.  Violation occurred on or about 03/29/2022.

29 CFR  1910.95(g)(6):  At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels :  a) Facility  An annual audiogram was not obtained for each employee exposed at or above an 8-hour time-weighted average of 85 decibels and employees exposed at or above an 10.5-hour time-weighted average of 83.4 dBA.  An employee (not provided a 2020 and 2021 audiometric exam) operating the screw machine was exposed to continuous noise levels that were equivalent to 107.4%, allowable dose of 40% for a 10 hour time weighted average. Exposures equivalent to a 10 hour Time Weighted Average of 90.5 dBA exceeded the Action Level of 83.4 dBA. The sample time was 571 minutes. Zero exposure was assumed for the unsampled time period of 59 minutes.  An employee (not provided a 2020 and 2021 audiometric exam) operating the punch press was exposed to continuous noise levels that were equivalent to  92.9% of the allowable dose of  50% for 8 hour time weighted average.
