29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer had not ensured that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a.  On or about February 22, 2022, employees working at the North Circle of the Cleaning Department in Building 56 of the Wire Mill were exposed to fall hazards of over four feet because the employer had not ensured the pit where the acid tanks were housed was guarded.  b.  On or about February 22, 2022, employees working at the South Circle of the Cleaning Department in Building 56 of the Wire Mill were exposed to fall hazards of over four feet because the employer had not ensured the pit where the acid tanks were housed was guarded.

29 CFR  1910.28(b)(3)(iv):  The employer had not provided that each employee be protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used:  On or about February 22, 2022, employees accessing the fixed ladder to perform crane inspections in the North Circle of the Cleaning Department in Building 56 of the Wire Mill were exposed to fall hazards of approximately 12 feet because the employer had not ensured a self-closing gate was located at the top of the fixed ladder.
