29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about February 28, 2022, employees were exposed to a struck by hazard while performing roofing activities on a residential home located at 484 Auld Farm Circle.  Employees were working on upper areas with tools and materials that could have fallen on lower employees and the employer did not ensure that the lower employees were wearing protective helmets.

29 CFR  1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:   The employer does not protect each employee from struck by hazards while performing roofing activities on a residential home by providing eye and face protection while the employees are using air powered nail guns.  a) This most recently occurred on February 28, 2022, while performing roofing activities on a residential home located at 484 Auld Farm Circle, Akron, Ohio 44320.  Employees are exposed to the hazard of  being struck by flying objects , while using air powered nail guns without wearing protective safety glasses.  To abate the hazard in the future, the employer must ensure that its employees are protected from the hazard of being struck by while performing roofing activities  using the air powered nail guns.   Pursuant to 29 CFR 1903.19 the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.  Benny Troyer DBA Benny Troyer Roofing was previously cited for a violation of this occupational safety and  health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection  number 691958, citation number 1, item number 1, and was affirmed as a final order on 11/15/12, with respect to  a workplace located at 1066 Eastland, Akron, Ohio 44306. 29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are not protected by guardrail systems, safety net system, or personal fall arrest system, nor are employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   The employer does not protect each employee from fall hazards while performing roofing activities on a residential home with unprotected edges at heights of approximately 20 feet above a lower level by the use of guard rail systems, safety net systems, or personal fall arrest systems.   a) This most recently occurred on February 28, 2022, while performing roofing activities on a residential home located at 484 Auld Farm Circle, Akron, Ohio 44320. Employees are exposed the hazard of falling approximately 20 feet to the ground while involved in roofing activities near the unprotected edges of the upper levels of the residential home.    To abate the hazard in the future, the employer must ensure that its employees are protected from the hazard of falling while performing roofing activities along the unprotected edges of the residential home.   Pursuant to 29 CFR 1903.19 the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards. 29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  On or about February 28, 2022, employees were exposed to a fall of approximately 20 feet while performing roofing activities on a residential home located at 484 Auld Farm Circle, Akron, Ohio 44320.  The employees were using an extension ladder to access the roof and the employer did not ensure that it extended three feet above the landing area.
