29 CFR 1926.404(b)(1)(i): General. The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors:  location: 10th floor on or about: 2/1/22  a) Employees were using electrical equipment, including a Hitachi C10FSB slide compound miter saw, while engaged in carpentry work. The employees were not using GFCI protection nor an assured equipment grounding conductor program.  NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:   location: 10th floor on or about: 2/1/22  a) An employee was using  a Hitachi C10FSB slide compound miter saw. The casing of the tool was cracked and partially missing.  NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:  location: 10th floor on or about: 2/1/22  a) An employee was using an electric cord to power a Hitachi C10FSB slide compound miter saw. The cord was missing the grounding pin.   NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
