29 CFR  1910.178(l)(2)(ii):The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  Plant 2, Shred and Cryo Department- On or about February 24, 2022, the employer did not ensure that an employee who was provided formal instruction, was also provided hands on training, evaluated, and certified to perform tasks and operate the equipment in a safe manner.  The employee operated the Toyota 6, Model #7HBW23, Serial #7HBW23-57614, and Jungheinrich 8, Model # EJE 120 US, Serial #98296998, walk behind electric pallet jacks.    b) Plant 2, Shred and Cryo Department- On or about March 6, 2022, the employer did not ensure that an employee who was provided formal instruction, was also provided hands on training, evaluated, and certified to perform tasks and operate the equipment in a safe manner.  The employee operated the Toyota 6, Model #7HBW23, Serial #7HBW23-57614, and Jungheinrich 8, Model # EJE 120 US, Serial #98296998, walk behind electric pallet jacks.    No abatement certification or documentation is required for this item.

29 CFR  1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator was involved in an accident or near-miss incident:   a) Plant 2, Shred Department- On or about March 7, 2022, the employer did not conduct refresher training, including an evaluation of the forklift operator's knowledge and skill on relevant topics, following near miss incidents or accidents.  No abatement certification or documentation is required for this item.

29 CFR 1910.178(l)(6): The employer did not maintain certification that each operator has been trained and evaluated as required by this paragraph (l), containing information including the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:  a) Plant 2- On or about April 5, 2022, the employer did not maintain certification records for recent hires that operate powered industrial vehicles, including the Toyota 6, Model #7HBW23, Serial #7HBW23-57614, and Jungheinrich 8, Model # EJE 120 US, Serial #98296998, walk behind electric pallet jacks.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
