29 CFR  1910.178(l)(4)(ii): Refresher training in relevant topics shall be provided to the operator when:   29 CFR  1910.178(l)(4)(ii)(B):  The operator has been involved in an accident or near-miss incident;   a.  On or about April 25, 2022, the employer did not provide refresher training after an operator was involved in a near-miss incident when they operated the power industrial vehicle such as, but not limited to the Raymond, Model 8410, S/N 841-16-32868, End Rider Pallet Truck.  The operator struck another pallet when he maneuvered the pallet truck.

29 CFR  1910.178(o)(1):  Only stable or safely arranged loads shall be handled. Caution shall be exercised when handling off-center loads which cannot be centered.  a.  On or about April 29, 2022, the employer did not ensure that packaged products  were safely arranged and positioned onto the pallet truck when an employee proceeded to move the load at the worksite location.  Employees were exposed to a struck-by hazard from the load of packaged products that was unstable as a result.
