29 CFR 1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees. The employer failed to protect employees from hazards associated with trenching operations. This was most recently documented on or about May 10th, 2022, in Omaha, Nebraska 68101. The employer did not provide a safe means of egress for the employees working in the trench. The ladder that was located in the trench was over 30 feet from where the workers were working in the trench.

The slopes and configurations of sloping and benching systems shall be selected and constructed by the employer or his designee and shall be in accordance with the requirements of paragraph (b)(1); or, in the alternative, paragraph (b)(2); or, in the alternative, paragraph (b)(3); or, in the alternative, paragraph (b)(4), as follows: The employer failed to protect employees from cave-in hazards associated with trenching operations. This was most recently documented on or about May 10th, 2022, in Omaha Nebraska 68101. Multiple individuals were observed working in an unprotected trench that was not adequately benched.
