29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace:   In the facility at 759 Chestnut St Springfield, MA 01199: On or about June 9, 2022, employees required to use N95 and/or PAPR respirators during tasks, such as, but not limited to, the provision of medication, treatment, and other care as necessary to residents confirmed positive for COVID-19, were not medically evaluated for their ability to use a respirator. The following instances were found to be in violation of the standard:  At the facility on or about June 9, 2022, at least one (1) employee was not medically evaluated prior to been required to wear a PAPR respirator to provide care to COVID positive patients in the Pediatric Unit.

29 CFR 1910.134(f)(2): The employer did not ensure that employees using a tight-fitting respirator were fit tested prior to initial use of the respirator, whenever a different respirator facepiece was used, and at least annually thereafter:    At the Facility at 759 Chestnut St. Springfield MA 01199: On and about May 26, 2022, the employer did not provide a fit test to employees required to wear a respirator, prior to initial use of the respirator, when a different respirator was used and at least annually thereafter. Employees were required to wear N95 filtering-facepiece respirators to protect against SARS-CoV-2 virus while providing care, such care as feeding, washing, dressing, treatment and other clinical and/or personal care, to suspected and confirmed COVID-19 positive patients.    On and before June 09, 2022, at least eight (8) employees included were fit tested initially however they were not fit tested annually thereafter. Out of these eight (8) employees, six (6) were COVID positive between May 26, 2022, and June 9, 2022, after exposure to COVID positive patients.
