OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish the employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm from being exposed to fall hazards. a) At the worksite, 4 Shirley Avenue, Moorestown, NJ - Backyard: The employer failed to ensure the employee cutting the tree was safe from struck by hazards from felled top section of the tree striking the section of the tree the employee was tied off to on or about July 6, 2022. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present. a) At the worksite, 4 Shirley Avenue, Moorestown, NJ - Backyard: Employees were felling trees and using equipment such as but not limited to chain saw(s), woodchipper(s), and other cutting tools. The employer did not conduct an assessment at this worksite to determine the hazards present, or are likely to be present, which necessitate the use of personal protective equipment, on or about July 6, 2022. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
