OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that e they were exposed to a falling filter plate struck by hazards: American Standard Brands located at 605 South Ellsworth Avenue Salem, OH 44460. On and before August 18, 2022, at the Perrin Model 100-S-48 Wastewater Treatment Sludge Filter Press, serial number 15709, employees who were required to clean the filter press with damaged angle bars and filter press rollers/wheels, were exposed to struck by hazards from the filter press plates falling off during the cleaning process.

(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: On or about August 10, 2022, the employer did not ensure employees operating and cleaning the Perrin Model 100-S-48 Wastewater Treatment Sludge Filter Press, serial number 15709, were protected from falling approximately 9 1/2 feet from the walking-working surface platform into the cake bin below, by a guardrail systems, safety net system, and/or personal fall protection system.
