29 CFR  1910.146(c)(6):When there were changes in the use or configuration of a non-permit confined space that could increase the hazards to entrants, the employer did not reevaluate that space and, when necessary, reclassify it as a permit-required confined space.   (a)On 8/15/2022   and at times earlier, in the Coke Hopper, contractor employees were exposed to falls of up to 13 feet to the bottom of the hopper, and hazardous energy at the point of operation for the vibrator because the employer did not re-evaluate the hopper prior to the work to install a new liner in the hopper, which created new hazards requiring reclassification of the hopper as a permit required confined space.

When an employer arranged to have employees of another employer (contractor) perform work that involved permit space entry, the host employer did not inform the contractor that the workplace contained permit spaces and that permit space entry is allowed only through compliance with a permit space program meeting the requirements of this section.  (a) On 8/15/2022   and at times earlier, in the Coke Hopper, contractor employees were exposed to falls of up to 13 feet to the bottom of the hopper, and hazardous energy at the point of operation for the vibrator because  ACICPCO did not inform CORE that work in the coke hopper  involved entry into a permit space and that entry into the hopper was  allowed only through compliance with a permit space program meeting the requirements of this section.

When an employer arranged to have employees of another employer (contractor) perform work that involved permit space entry, the host employer did not apprise the contractor of the elements, including the hazards identified and the host employer's experience with the space, that make the space in question a permit space.  (a)On 8/15/2022  and at times earlier, in the Coke Hopper, contractor employees were exposed to falls of up to 13 feet to the bottom of the hopper, and hazardous energy at the point of operation for the vibrator because when ACIPCO arranged to have CORE employees perform work that involved permit space entry, ACIPCO did not apprise CORE of the elements, including the hazards identified and  ACIPCO's experience with the coke hopper, that made it a permit space.

When an employer arranged to have employees of another employer (contractor) perform work that involved permit space entry, the host employer did not apprise the contractor of any precautions or procedures that the host employer has implemented for the protection of employees in or near permit spaces where contractor personnel will be working.  (a)On 8/15/2022  and at times earlier, in/at the Coke Hopper, contractor employees were exposed to falls of up to 13 feet to the bottom of the hopper, and hazardous energy inside the hopper at the point of operation for the vibrator because  when ACIPCO arranged to have CORE employees (the contractor) enter the hopper to replace/repair/install the hopper liner, work that involved entry into the coke hopper (permit space entry), ACIPCO did not apprise CORE of any precautions or procedures that the ACIPCO had implemented for the protection of employees in or near the hopper where contractor personnel were working.
