On or about August 18, 2022, at the above addressed jobsite, employees working in a trench were exposed to struck by hazards due to the presence of a spoil pile and other tools and materials within two (2) feet of the edges of the trench.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. (a)  On or about August 18, 2022, at the above addressed jobsite, the employer failed to ensure a competent person removed employees from a trench after recognizing hazardous conditions that exposed employees to potential cave-in hazards.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a. On or about August 18, 2022, at the above addressed jobsite, an employee performing water main upgrade activities in a trench, seven (7) feet two (2) inches in depth, was not utilizing cave-in protection, thereby exposing the employee to cave-in hazards.
