29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   On or about September 13, 2022, the employer did not implement or maintain a hazard communications program containing the criteria contained in paragraphs (f), (g) and (h), exposing the employee to the hazards associated with Silica and Portland cement.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.451(b)(1)(i):Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.  On or about September 13, 2022, employees performed work from a metal framed scaffold that was not fully planked, exposing employees to a fall of 16 feet.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.451(b)(5)(ii): The end of a platform greater than 10 feet in length extended over its support more than 18 inches and the platform was not designed and installed so that the cantilevered portion of the platform is able to support employees without tipping, or has guardrails which block employee access to the cantilevered end.  On or about September 13, 2022, employees worked from scaffold planks that were cantilevered more than 18 inches past the scaffold supports, exposing employees to a fall of 16 feet.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
