Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On or about September 12, 2022, the employer did not ensure when frequent and regular inspections of the jobsite were conducted that the inspections included checking for struck-by/caught between hazards at the time of the pour exposing the employees to being struck by the Caterpillar Track Loader bucket during pour.

The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) On or about September 12, 2022, the employer did not ensure that employees who were exposed to struck-by/caught between hazards were adequately trained in the recognition and avoidance of hazards associated with holding the 2x4 marker board while sand is being poured by equipment such as but not limited to the Caterpillar Track Loader (Model: 953K Serial #: LIT00564)

29 CFR 1926.651(e): Exposure to falling loads. No employee shall be permitted underneath loads handled by lifting or digging equipment. Employees shall be required to stand away from any vehicle being loaded or unloaded to avoid being struck by any spillage or falling materials. Operators may remain in the cabs of vehicles being loaded or unloaded when the vehicles are equipped, in accordance with 1926.601(b)(6), to provide adequate protection for the operator during loading and unloading operations. a) On or about September 12, 2022 the employer did not ensure employees were not underneath loads of sand handled by equipment such as but not limited to the Caterpillar Track Loader (Model: 953K Serial Number: LIT00564) in that employees were exposed to struck-by/caught between hazards when holding a 2x4 marker post while sand is being poured.
