29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:   a) On or about 09/15/2022 at 320 Broad St. Tonawanda, NY;  employee was working on a roof surface at 13 feet above lower level without the use of fall protection. The employer did not enforce the use of fall protection.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  a) On or about 9/15/2022 at the roof area of the site, side rails of the extension ladder extended 1.5 feet above the upper landing surface being accessed.  NO ABATEMENT CERTIFICATION REQUIRED
