29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) On or before September 23, 2022, and at times prior, a safe means of egress was not provided for two employees working in a trench ranging from 6 to 8 feet in deep.  Although a 5-foot tall, A-frame ladder was located inside the trench, which was shorter than depth of the excavation, it was not secured from accidental displacement and was not used for its intended purpose.  This A-frame ladder did not provide a safe means of egress.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  a) On or before September 23, 2022, and at times prior, the employer failed to ensure that daily inspections of the site and protective systems were conducted by a competent person. Two employees were working in an unprotected trench with vertical walls that ranged in depth from 6 to 8 feet. The employees were exposed to cave in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):  a)  On or about September 23, 2022, and at times prior, two employees were not protected from cave-in hazards while installing 4-inch sewer pipes in an unprotected trench.  The trench was approximately 3 feet wide and had vertical walls ranging from 6 to 8 feet in depth where the employees were working. The employees were exposed to cave in hazards.
