On or about September 28, 2022, and at times prior thereto, the employer provided and required the use of respirators for employees to wear while performing painting operations without a written respiratory protection program, exposing employees to the hazards of wearing a respirator.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59): On or about September 28, 2022, and at times prior thereto, the employer did not develop, implement, and maintain a written hazard communication program prior to requiring employees to perform painting operations with the use of hazardous materials, such as but not limited to, Pro Industrial Urethan Alkyd Enamel Ultradeep Base, exposing employees to inhalation and absorption hazards.
