29 CFR  1910.30(a)(1):(a) Fall hazards. (1) Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart.  Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017.  On or about October 11, 2022, at a residence located at 1082 Olson Avenue Oshkosh, Wisconsin; the employer did not provide training on fall hazards in the work area and how to recognize them prior to an employee being exposed to fall hazards while working from an elevated basket to remove tree limbs at heights of approximately 35 feet.

29 CFR  1910.67(c)(2)(v): A personal fall arrest or travel restraint system that meets the requirements in 29 CFR part 1910, subpart I, shall be worn and attached to the boom or basket when working from an aerial lift.  On or about October 11, 2022, at a residence located at 1082 Olson Avenue Oshkosh, Wisconsin; the employer did not ensure that an employee in an aerial lift was wearing a personal fall arrest or travel restraint system that meets the requirements in 29 CFR part 1910, subpart I.  The employee was working from an elevated basket to remove tree limbs at heights of approximately 35 feet.

On or about October 11, 2022, at a residence located at 1082 Olson Avenue Oshkosh, Wisconsin; the employer did not ensure that an employee operating a chainsaw to remove branches was wearing appropriate eye or face protection.

On or about October 11, 2022, at a residence located at 1082 Olson Avenue Oshkosh, Wisconsin; the employer did not ensure that employees on the ground removing branches, that had been cut by an employee in an aerial basket approximately 35 feet above, were wearing protective helmets to protect the employees from injury to the head from falling branches.

On or about October 11, 2022, at a residence located at 1082 Olson Avenue Oshkosh, Wisconsin; the employer could not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  Employees are exposed to struck by hazards and fall hazards while cutting and removing trees using a chainsaw and an aerial lift truck.
