29 CFR  1918.61(d): Cargo handling gear and/or other material handling devices were used by the employer before the devices were certificated, as evidenced by current and valid documents by an OSHA accredited agent or agency in accordance with 29 CFR Part 1919:  a) On or about October 10, 2022, at the southern end of the loading pier, the employer failed to ensure that a Komatsu 270 excavator had an initial inspection prior to use.
