29 CFR  1910.1200(e)(1):Employer had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (Construction Reference: 1926.59)   At 17336 Ballentine, Overland Park, KS 66224 employees engaged in brick tile cutting activities are exposed to Respirable Crystalline Silica and no written hazard communication program had not been developed and implemented. Exposure to respirable crystalline silica puts workers at risk for developing other serious diseases including lung cancer and chronic obstructive pulmonary disease (COPD).

29 CFR 1926.1153(i)(2)(i):The employer did not ensure that each covered employee could demonstrate knowledge and understanding of at least the information contained in paragraphs (A) - (F) of this section.  At 17336 Ballentine, Overland Park, KS 66224 employees engaged in brick tile cutting activities are exposed to Respirable Crystalline Silica (RCS) and were not aware of the hazards associated with it. Exposure to RCS puts workers at risk for developing serious diseases including lung cancer and/or chronic obstructive pulmonary disease (COPD).

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  At 17336 Ballentine, Overland Park, KS 66224 employees engaged in brick tile dry-cutting activities with handled power saws are exposed to Respirable Crystalline Silica (RCS) and proper controls were not implemented. Employees  did not implement wet methods when cutting brick tiles not had respiratory protection. Exposure to RCS puts workers at risk for developing serious diseases including lung cancer and/or chronic obstructive pulmonary disease (COPD).
