29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. a. On or about November 14, 2022, the employer did not develop and implement an energy control program consisting of machine specific energy control (lockout/tagout) procedures, employee training and periodic inspections to ensure that potentially hazardous energy is controlled on machines and/or equipment while employees performed service and maintenance covered activities. On November 14, 2022, an employee was caught-in an energized drive belt and pully at the Baldor Reliance SuperE Motor, Serial# F2009032480, Cat No. EM3615T for the Green Chain conveyor while servicing the equipment at start-up.

29 CFR 1910.219(d)(1):Guarding. Pulleys, any parts of which are seven (7) feet or less from the floor or working platform, shall be guarded in accordance with the standards specified in paragraphs (m) and (o) of this section. Pulleys serving as balance wheels (e.g., punch presses) on which the point of contact between belt and pulley is more than six feet six inches (6 ft. 6 in.) from the floor or platform may be guarded with a disk covering the spokes. a. On or about November 16, 2022 the employer did not ensure that the metal guards installed enclosed the rotating belt and pulleys for the Baldor Reliance SuperE Motor, Serial# F2009032480, Cat No. EM3615T at the end of the green chain, thereby exposing employees walking and working at the end of the conveyor to caught-in hazards.
