29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) Mechanical Room: On November 18, 2022, an employee wore a full face WorkMask TM SCBA (Self Contained Breathing Apparatus) respirator to check the inside the chiller room. Employees had not been medically evaluated on respirators, exposing employees to respiratory hazards.

Employees had not been fit tested on respirators, exposing employees to respiratory hazards.

29 CFR 1910.134(h)(3)(i): Employer did not ensure that respirators were inspected as follows: all respirators used in routine situations inspected before each use and during cleaning; all respirators maintained for use in emergency situations inspected at least monthly and in accordance with the manufacturer's recommendations, and checked for proper function before and after each use; and emergency escape-only respirators inspected before being carried into the workplace for use:  (a) Mechanical Room: On November 18, 2022, the employer failed to ensure a full face WorkMask TM SCBA (Self Contained Breathing Apparatus) respirator, used to enter a hazardous atmosphere, had been inspected and maintained as required.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:  (a) Mechanical Room: On November 18, 2022, the employer did not ensure an employee who utilized a full face WorkMask TM SCBA (Self Contained Breathing Apparatus) respirator was free of facial hair in order to ensure a correct seal for the mask, exposing the employee to respiratory hazards.
