1926.20(b)(2) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. 29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: On or about November 30, 2022, at a worksite located at the SW corner of Shady Lane and Clayton Ave (Parcel 121021007), Fox Crossing, Wisconsin; The employer had not instructed employees engaged in site preparation and pipe installation tasks to not enter the danger zone of running equipment without the equipment controls disengaged and parked.

29 CFR 1926.600(a)(3)(ii): Whenever the equipment is parked, the parking brake shall be set. Equipment parked on inclines shall have the wheels chocked and the parking brake set. On or about November 30, 2022, at a worksite located at the SW corner of Shady Lane and Clayton Ave (Parcel 121021007), Fox Crossing, Wisconsin; An employee was exposed to struck-by and crushing hazards when the pilot shutoff lever was not set on the John Deere 350P excavator prior to the operator leaving the seat of the equipment and opening the door. The employee was standing in front of the equipment's track attempting to communicate with the equipment operator.
