29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  a. On or about December 12, 2022 the employer Robert Wagner Roofing LLC. at jobsite located at 1015 Navarre Ave. Toledo OH 43605, did not ensure employees were protected from falls while performing roofing activities atop a low sloped commercial structure. Two employees performing roof shingle tear off on the structure were exposed to a 9 foot or greater fall to the ground below on a 3:12 pitch roof.

29 CFR  1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a. On or about December 12, 2022 the employer Robert Wagner Roofing LLC. at jobsite located at 1015 Navarre Ave. Toledo OH 43605, did not have a plan or a program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls hazards during job site operations, decreasing the probability of employee injury or illness.    Robert Wagner Roofing LLC was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(1) which was contained in OSHA inspection number 1429401, citation number two, item number one and was affirmed as a final order on November 14, 2019 with respect to a workplace located at 320 W. Maple St. Liberty Center OH 43532.
