OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:  a) On or about 12/20/2022 at a construction site located at 5810 South Transit Road, Lockport, New York; employees were removing metal roofing on a building using a material/debris platform attached to the forks of a rough terrain forklift. The use of a material platform was not approved for use to lift personnel by the forklift manufacturer, exposing employees to a fall hazards.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a) On or about 12/20/2022 at a construction site located at 5810 South Transit Road, Lockport, New York; employees were removing metal roofing on a building using a material/debris platform attached to the forks of a rough terrain forklift. The employees in the platform did not have a harnesses with lanyards attached to the boom or basket while operating the lift.  NO ABATEMENT CERTIFICATION REQUIRED
