OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards during arboricultural operations: (a) At the worksite, during tree removal: On or about 12/28/22, the employer allowed an employee to climb a tree with severely rotted roots, exposing the climber to fall and struck-by hazards.

(a) At the worksite, during tree removal operations: On or about 12/28/22, a climbing arborist was hoisted into a tree by "riding the hook" of an Altec 38-126S hydraulic truck crane.
