29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). "AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)". On or about November 30, 2022, the employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely in the following instances. 1) The employee welded the first steel pipe to the top (Right side) of the covered parking structure while standing on a wooden platform on one fork of the forklift. 2) The employee was welding the second steel pipe to the top of the (Center) covered parking structure while standing on a wooden platform on one fork of the forklift at the time of the incident.

29 CFR 1926.451(c)(2)(v): A fork-lift was used to support scaffold platforms where the entire platform was not attached to the fork. On or about November 30, 2022, the employer allowed an employee to use a Load Lifter 6000 (Model #221416D/Serial #3357) to support a scaffold platform when it was not specifically designed by the manufacturer for such use in the following instances. 1) The employee welded the first steel pipe to the top (Right side) of the covered parking structure. 2) The employee welded the second steel pipe to the top of the (Center) covered parking structure at the time of the incident.
