On or about February 24, 2023, and at times prior, the employer did not ensure that the 2015 and 2018 Process Hazard Analysis (PHA) for the MIBK Recovery Unit (MRU) covered process addressed consequences of failure of engineering and administrative controls such as, but not limited to, any and all of the high-level alarms, high-level transmitters, and high-level devices as well as their associated interlocks. These included, but were not limited to, LSH-S873, LSH-S884, LSH-994(LSH-998), LAH-S954, LAH-S956, LT-S884, and LT-S966. 29 CFR 1910.119(f): Operating procedures. 29 CFR 1910.119(f)(1): The employer shall develop and implement written operating procedures that provide clear instructions for safely conducting activities involved in each covered process consistent with the process safety information and shall address at least the following elements. 29 CFR 1910.119(f)(1)(i): Steps for each operating phase: 29 CFR 1910.119(f)(1)(i)(D): Emergency shutdown including the conditions under which emergency shutdown is required, and the assignment of shutdown responsibility to qualified operators to ensure that emergency shutdown is executed in a safe and timely manner. a. On or about December 29, 2022, and at times prior, the employer did not ensure that it's procedure for emergency shutdown for the Stripper Building/MIBK Recovery Unit (MRU) covered processes included all of the necessary steps and was properly implemented with affected employees. The emergency shutdown procedure for the Stripper Building/MRU did not include the use of the "emergency stop" buttons in the procedure or the steps on how to shut down the MRU. Employees working on and in the vicinity of the MRU covered process were exposed to fire, explosion, and contact hazards.

The employer shall train each employee involved in maintaining the on-going integrity of process equipment in an overview of that process and its hazards and in the procedures applicable to the employee's job tasks to assure that the employee can perform the job tasks in a safe manner. a. On or about December 29, 2022, and at times prior, the employer did not ensure that all employees involved in maintaining the on-going integrity of process equipment such as, but not limited to, the MIBK Recovery Unit (MRU) covered process and its associated equipment, were trained in its hazards and in the procedures applicable to their job tasks to assure performance of these tasks in a safe manner. Employees performed tasks such as, but not limited to, inspections/ "proof tests" of the high-level alarms, high-level transmitters, high-level devices and their associated interlocks, and the physical emergency stop on the exterior of the Stripper Building. These included, but were not limited to, LSH-S873, LSH-S884, LSH-994(LSH-998), LAH-S954, LAH-S956, LT-S884, and LT-S966. Employees working on and in the vicinity of the MRU covered process were thereby exposed to fire, explosion, and contact hazards.

29 CFR 1910.119(j)(5): Equipment deficiencies. The employer shall correct deficiencies in equipment that are outside acceptable limits (defined by the process safety information in paragraph (d) of this section) before further use or in a safe and timely manner when necessary means are taken to assure safe operation. a. On or about January 12, 2023, and at times prior, the employer did not correct deficiencies in equipment that were outside of acceptable limits such as, but not limited to, the fire suppression system associated with Building 2's warehouses where large quantities of highly hazardous materials including flammable materials were stored. The PSM covered processes CR1, C-Line and D-Line located in the building continued to run without a working fire suppression system in the warehouse areas. Employees working on and in the vicinity of the MRU covered process were exposed to fire, explosion, and contact hazards. b. On or about December 29, 2022, and at times prior, the employer did not correct equipment deficiencies for the MIBK Recovery Unit (MRU) covered process controls that were outside of acceptable limits such as, but not limited to, the physical emergency stop for the Stripper Building. The emergency stop on the exterior of the building was not working properly. Employees working on and in the vicinity of the MRU covered process were exposed to fire, explosion, and contact hazards. c. On or about December 29, 2022, and at times prior, the employer did not correct equipment deficiencies for the MIBK Recovery Unit (MRU) covered process controls that were outside of acceptable limits such as, but not limited to, the high-level switch device LSH S873 for MRU Reflux Drum 109, level controller LIC S873 for MRU Reflux Drum 109, high-level switch LSH S884 for Column 2/MRU Column 609, level control valve LCV S884 for Column 2/MRU Column 609, level controller LIC S884 for Column 2/MRU Column 609, and the associated high-level interlocks on each of the vessels of the covered process. The high-level alarms and associated interlocks did not function properly resulting in a spill/release of MIBK. Employees working on and in the vicinity of the MRU covered process were exposed to fire, explosion, and contact hazards.
