29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system: (a) On or before January 13, 2023, the employer did not ensure that employees were protected from injury, in that three employees who were installing a new tile roof on the second story roof as well as the first story roof did not utilize a fall protection system. This condition exposed employees to fall hazards of approximately 18 and 10 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards: (a) On or before January 13, 2023, the employer did not ensure that each employee engaged in roofing operations was trained to recognize the hazards of working at elevation and trained in the use of fall protection, in that three employees who were installing a new tile roof on the second story roof as well as the first story roof did not utilize a fall protection system. This condition exposed employees to fall hazards of approximately 18 and 10 feet.
