29 CFR  1926.502(d)(16)(iii):Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:  (a) At the site, on or about 1/9/2023, the employer exposed employees to fall hazards, in that Werner lanyards being used as part of a personal fall arrest system by employees on an approximately 12 foot 7 inch fall height, were not rigged in such a way to prevent employees from contacting the lower level during a fall.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  a) On or about January 10, 2023 at the Pool Pavilion in 2171 Treeline Ave, Fort Myers, FL, 33913, the employer failed to report to OSHA, within 24-hours, a work-related in-patient hospitalization of an employee.  The employer notified OSHA on January 13,  2023,  of the in-patient hospitalization.
