On February 1, 2023, and days prior, the data plate on the Mitsubishi FG40 powered industrial vehicle was not legible, in that the proper center of gravity for loads on the forks could be determined in accordance to the data plate.

29 CFR 1910.178(o)(1):Only stable or safely arranged loads shall be handled. Caution shall be exercised when handling off-center loads which cannot be centered. A.) On February 1, 2023, while painting the door frame and a doors of a safe, employees were exposed to struck by and crushing hazards from a load that was not lifted in a stable manner by a Mitsubishi FG40 Powered Industrial Vehicle.

29 CFR 1910.178(o)(5):A load engaging means shall be placed under the load as far as possible; the mast shall be carefully tilted backward to stabilize the load. A.) On February 1, 2023, the forks of the Mitsubishi FG40 Powered Industrial Vehicle were not placed completely under the load that was being lifted, exposing employees to struck by and crushing hazards from falling loads.
