OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm from crushing hazards to employees due to collapse or tip-over of a storage rack system:  (a) Warehouse A, Side Wall: On or about February 17, 2023, and times prior, employees used forklifts to load and unload material on the storage rack system. Employees were exposed to crushing hazards from a collapse or tip-over of a storage rack system due to unanchored rack columns that affect the stability of the storage rack system.   (b) Warehouse B, Back Wall: On or about February 17, 2023, and times prior, employees used forklifts to load and unload material on the storage rack system. Employees were exposed to crushing hazards from a collapse or tip-over of a storage rack system due to unanchored rack columns that affect the stability of the storage rack system.   (c) Warehouse C, Back Wall: On or about February 17, 2023, and times prior, employees used forklifts to load and unload material on the storage rack system. Employees were exposed to crushing hazards from a collapse or tip-over of a storage rack system due to unanchored rack columns that affect the stability of the storage rack system.   (d) Warehouse D, Side Wall: On or about February 17, 2023, and times prior, employees used forklifts to load and unload material on the storage rack system. Employees were exposed to crushing hazards from a collapse or tip-over of a storage rack system due to unanchored rack columns that affect the stability of the storage rack system.
