29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: a) Hot Kitchen: Sanitation employees cleaned surfaces by spraying Chlorinated Alka-Plus Foaming Liquid (corrosive) and Extract 2 (corrosive) and the eyewash in the room was not operational in the kitchen; on or about 2/16/23. b. Raw Wash Room: Sanitation employees cleaned surfaces using Chlorinated Alka-Plus Foaming Liquid (corrosive) and the eyewash in the room was not operational and was blocked by a drum of chemicals; on or about 2/16/23. c. RTE - Dishwash Room: Sanitation employees cleaned surfaces using Chlorinated Alka-Plus Foaming Liquid (corrosive) and the eyewash in the room was not operational; on or about 2/16/23. Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) Chemical Storage Room: An employee filling Chlorinated Alka-Plus Foaming Liquid (corrosive) and Extract 2 (corrosive) into portable wheeled tanks did not wear chemical protective apron and boots on or about 7/5/23. The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19, failure to comply will result in additional penalty of $ 1,000.00
