29 CFR 1910.178(l)(6):Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. (a) On January 21, 2023, an employee was operating a SkyTrak JLG Telehandler Forklift to lift Insulated Concrete Forms from the ground to the fifth floor in that the employer did not have written certification to verify the employee had been trained and evaluated to operate the forklift.

29 CFR 1926.501(b)(3):"Hoist areas." Each employee in a hoist area shall be protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems or personal fall arrest systems. If guardrail systems, [or chain, gate, or guardrail] or portions thereof, are removed to facilitate the hoisting operation (e.g., during landing of materials), and an employee must lean through the access opening or out over the edge of the access opening (to receive or guide equipment and materials, for example), that employee shall be protected from fall hazards by a personal fall arrest system. a) On February 21, 2023, located on the southwest corner of a commercial structure, an employee was exposed to a fall hazard standing at the edge of an open floor while waiting for a SkyTrak JLG Telehandler Forklift to raise Insulated Concrete Forms (ICF) from the ground to the fifth floor and not utilizing any fall protection system. Potential fall height was measured to be 46'-3 ?".

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. (A) Guardrail systems; (B) Safety net systems; or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. (a) On February 21, 2023, located on the southwest corner of a commercial structure, the employer failed to install a fall protection system before an employee was exposed to a fall hazard while standing at the edge of an open floor waiting for a SkyTrak JLG Telehandler Forklift to hoist material to the fifth floor. Potential fall height measured to be 46'-3 ?".
