29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: a) On or about February 24, 2023, and at times prior, employees were exposed to crushing and struck-by injuries in that, powered industrial truck #5 had low battery water level, and there was an error code indicating the brake needed to be recalibrated. The forklift and was not in safe operating condition and was not taken out of service. b) On or about February 27, 202, and at times prior, employees were exposed to crushing and struck-by injuries in that powered industrial truck #5 had low battery water level and was not taken out of service.
