OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and engulfment hazards: (a) Yuma Ethanol Plant: On or about 2/27/2023, and at times prior, Jim Dickinson Trucking, LLC did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, under the owners direction, an employee cut the tractor trailer tarp from within the trailer to remove hot corn mash which was mistakenly loaded onto the tarp. This condition exposed an employee to struck-by and engulfment hazards.
