29 CFR  1926.20(b)(4): The employer failed to permit only those employees qualified by training or experience to operate equipment and machinery:  a) Main room suite 6 - On or about March 7, 2023 and at times prior thereto, an employee operated a Bobcat T650 Compact Skid Steer Track Loader and was not qualified by training in the recognition and avoidance of unsafe conditions related to operation of skid steer loaders. The employer did not permit employees who were qualified by training or experience to operate the Bobcat.  An employee was struck-by the Bobcat and sustained serious injury.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Main room suite 6 - On or about March 7, 2023 and at times prior thereto, an employee operated a Bobcat T650 Compact Skid Steer Track Loader and was not instructed in the recognition and avoidance of unsafe conditions related to operation of skid steer loaders. The employer did not instruct the employee in the recognition and avoidance of unsafe conditions and regulations applicable to control or eliminate hazard or other exposure to injury to include struck-by hazards. An employee was struck-by the Bobcat and sustained serious injury.
