29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about February 6, 2023, employees were exposed to a fall of approximately 18 feet while performing roofing activities on a residential home located at 3748 E Royalton Road, Brecksville, Ohio 44141.  The employees were working on all areas of the roof and the employer did not ensure they were using fall protection.  Lovell Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1263203, citation number 1, item number 1, and was affirmed as a final order on 0/17/17, with respect to a workplace located at 3805 Leopold Ave., Cleveland, Ohio 44109.  Lovell Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1394075, citation number 2, item number 1, and was affirmed as a final order on 06/07/19, with respect to a workplace located at 3710 Longwood Dr., Parma, Ohio 44134.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:(a)    On or about February 6, 2023, employees were exposed to a fall of approximately 18 feet while performing roofing activities on a residential home located at 3748 E Royalton Road, Brecksville, Ohio 44141.  The employees were using an extension ladder to access the top level and the employer did not ensure it extended three feet above the landing area.  Lovell Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1394075, citation number 1, item number 1, and was affirmed as a final order on 06/07/19, with respect to a workplace located at 3710 Longwood Dr., Parma, Ohio 44134.
