29 CFR 1926.404(b)(1)(iii)(C): Each cord set, attachment cap, plug and receptacle of cord sets, and any equipment connected by cord and plug, except cord sets and receptacles which are fixed and not exposed to damage, shall be visually inspected before each day's use for external defects, such as deformed or missing pins or insulation damage, and for indications of possible internal damage. Equipment found damaged or defective shall not be used until repaired. a. On or before March 16, 2023, where employees used an extension cord that was cut through the insulation to provide electrical power to a circular saw, the cord was not inspected and removed from service, thereby exposing the employees to an electrical contact hazard.

29 CFR 1926.451(c)(2)(v):Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied. a) BH&D Construction LLC, at the jobsite located at 1981 Glassboro St., Newark, Ohio 43055: On or about March 16, 2023, an employee was working from an elevated platform of OSB sheathing that was not attached to the Gradall rough terrain forklift (model: 544D-10; S/N: 0160001767), thereby exposing the employees to fall hazards greater than 11 feet.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) BH&D Construction LLC, at the jobsite located at 1981 Glassboro St., Newark, Ohio 43055: On or about March 16, 2023, the employer did not ensure fall protection was utilized by employees engaged in framing activities to a two-story residential house, thereby exposing the employees to fall hazards greater than 18 feet.

Employees were utilizing a 6 foot Werner step ladder in the closed position to access the second-story roof, thereby exposing the employees to fall hazards greater than 17 feet.
