29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use (Reference Construction Standard 29 CFR 1926.103):  a) 80 Edwards Ave, Bridgeton, NJ - The employer did not establish a worksite specific respiratory protection program for the employees who were required to use 3M elastomeric half face respirator with a HEPA filter thus exposing employees to respiratory distress. This condition was observed on or about  March 16, 2023.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace(Reference Construction Standard 29 CFR 1926.103):  a) 80 Edwards Ave, Bridgeton, NJ - Employees required to wear 3M elastomeric half face respirator with HEPA filters were not medically evaluated prior to wearing the respirator, thus exposing employees to respiratory distress. This condition was observed on or about March 16, 2023.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
