29 CFR 1910.178(l)(3): Operator Training. Training program content. Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace. (i) Truck-related topics: (A): Operating instructions, warnings, and precautions for the types of truck the operator will be authorized to operate; (D): Engine or motor operation; (E): Steering and maneuvering; (F): Visibility (including restrictions due to loading); (L): Operating limitations; (M): Any other operating instructions, warnings, or precautions listed in the operator's manual for the types of vehicle that the employee is being trained to operate. a) On and before March 20, 2023, the employer had not provided initial training to employees in the language that they understood that operated the Tennant T16 Rider Scrubber in the language they understood that covered truck related topics that included the requirements of (A, D, E, F, L, and M) of the powered industrial truck requirements.

(ii) Workplace-related topics: (E): Narrow aisles and other restricted places where the vehicle will be operated a) On or before March 20, 2023, the employer had not provided adequate training in the language that they understood that covers narrow aisles and other restricted places to employees that operated the Tennant T16 Rider Scrubber. An employee cleaning in and around conveyers on the Tennant T16 Scrubber struck a conveyer located on the 4th floor that was 59" in height and an employee was lodged between the scrubber and the conveyer.

The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) On or before March 20, 2023, the employer failed to instruct each employee in the recognition and avoidance of unsafe conditions in the language that they understood on hazards such as, but not limited too; avoidance to low overhead hazards created from conveyers located 59" from the ground when operating the Tennant T16 Rider Scrubber while cleaning at the Amazon facility currently under construction.
