1926.454(c)(3):  The employer failed to retrain employees that showed indications through work performance of not retaining the requisite proficiency:  a) Lots 505/506 - Employees utilized an elevated platform which was attached to the boom of a Caterpillar TH460B telehandler. The platform and components were not capable of supporting loads as required in that the platform width was greater than the width of the truck (measured across the load bearing tires, plus 10 inches on either side), on or about March 17, 2023.  No abatement�certification or�documentation required.

1926.503(c)(3):  Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill:  a) Lots 501 through 506 - Employees installed roof trusses onto a 6-unit townhome building at heights of approximately 27-feet above grade and 9-feet above the interior floor and were not provided with any means of fall protection, on or about March 17, 2023.  b) Lots 501 through 506 - Employees installed roof sheathing onto a 6-unit townhome building at heights of approximately 27-feet above grade and 9-feet above the interior floor and were not provided with any means of fall protection, on or about March 17, 2023. 29 CFR 1926.602(c)(1)(viii)(A): The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel:   a) Lots 505/506 - The employer did not ensure the elevated platform utilized by employees installing roof sheathing was firmly secured to the quick coupler assembly on the boom of a Caterpillar TH460B telehandler. The quick coupler was not completely engaged onto the hooks of the platform and the locking pin and retaining clip were not utilized, on or about March 17, 2023. 29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks:   a) Lots 505/506 - an operator was not present at the controls of a Caterpillar TH460B telehandler while employees worked from an elevated platform which was attached to the boom approximately 27-feet high above grade, on or about March 17, 2023.  b) Lots 505/506 - Employees utilized an elevated platform which was connected to the boom of a Caterpillar TH460B telehandler at a height of approximately 27-feet above grade, and the employer failed to perform an inspection of the equipment after making a change in the attachments, on or about March 17, 2023.   c) Lots 501 through 506 - The employer allowed employees to operate a Caterpillar TH460B telehandler with a cracked windshield obstructing the view of the operator, on or about March 17, 2023.  No abatement�certification or�documentation required.

29 CFR 1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):    a) Lots 501 through 506 - Employees operated a Caterpillar TH460B telehandler and had not received a combination of formal instruction, practical training, and evaluation of the operator's performance, on or about March 17, 2023.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
