29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: On or about March 20, 2023, employees were exposed to struck-by and/or amputation hazards while performing maintenance, repairs and/or cleaning of the Accurshear shear machine.

29 CFR 1910.147(e)(2)(i):Before lockout or tagout devices were removed and energy was restored to the machine or equipment, authorized employees did not ensure that all employees had been safely positioned or removed from the work area: On or about March 20, 2023, employees were exposed to struck-by hazards when the area of the Accurshear Model 650010 shear machine had not been cleared of employees before restarting it after repairs were made.
