29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:  On or about 03/22/2023, at the west exterior elevation of Building 400 located at SE Collins Lane in Port Saint Lucie, Florida, employees performing balcony rail measuring work were exposed to fall hazards prior to the employer performing an inspection of the site to ensure employees had and were utilizing fall protection equipment while on the balconies.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   On or about 03/22/2023, at the west exterior elevation of Building 400 located at SE Collins Lane in Port Saint Lucie, Florida, employees performing balcony rail measuring work on a residential structure were exposed to fall hazards of approximately 10 to 20 feet while not being protected from falling to the lower level.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about 03/22/2023, at a construction site of located at SE 400 SE Collins Lane in Port Saint Lucie, Florida, employees performing balcony rail measuring work were exposed prior to being provided with training by a competent person that would enable them to recognize the hazards associated with falls, the proper use of fall protection equipment and procedures to be followed in order to minimize those hazards.
