29 CFR  1926.50(g): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  a) At 2696 White Sulphur Road, Gainesville, GA - On or about April 5, 2023, and at times prior, the employer exposed employees to chemical hazards in that, the employer failed to ensure the facilities for eyewash and/or safety shower were provided to employees before starting work while corrosive materials being used at the worksite.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) At 2696 White Sulphur Road, Gainesville, GA - On or about April 5, 2023, and at times prior, employees were exposed to chemical hazards in that, the employer did not provide hazard communication training while employees were working with Portland Cements at the worksite.

29 CFR  1926.451(f)(3):Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  a) Northwest side scaffold located at 2696 White Sulphur Road, Gainesville, GA - On or about April 5, 2023, and at times prior, employees were exposed to fall hazards in that, scaffolds were not inspected for use by a competent person prior to each work shift.   b) Northeast side scaffold located at 2696 White Sulphur Road, Gainesville, GA - On or about April 5, 2023, and at times prior, employees were exposed to fall hazards in that, scaffolds were not inspected for use by a competent person prior to each work shift.   c) Southeast side scaffold located at 2696 White Sulphur Road, Gainesville, GA - On or about April 5, 2023, and at times prior, employees were exposed to fall hazards in that, scaffolds were not inspected for use by a competent person prior to each work shift.   TET. Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(f)(3), which was contained in OSHA inspection number 1557689, citation number 1, item number 2, and was affirmed as a final order on January 21, 2022, with respect to a workplace located at 3655 Sardis Church Rd., Buford, GA.

29 CFR  1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  (Construction Reference 1926.103)   a) At 2696 White Sulphur Road, Gainesville, GA - On or about April 5, 2023, and at times prior to, the employer exposed employees to respiratory hazards in that, employees were permitted to use N95 respirators voluntary without reviewing information contained in appendix D of respiratory protection program while working at the worksite.
