OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees a. On or about April 6, 2023, DLC Equipme_nt Company Inc., at a worksite located at 1039 Greenside Lane, Columbus, OH 43235, did not ensure personnel were prohibited from lifting an employee in the bucket of a Komatsu Excavator Model No. PC] 38USLC-J 1, in order to trim tree limbs near the worksite. Lifting the employee in the bucket exposed the employee to hazards that could cause death or serious physical harm. Among other methods, one feasible and acceptable method to correct this hazard is to: Ensure employees are not lifted using the equipment which is contrary to the manufacturer's Operation & Maintenance Manual for the excavator. The manual states the "lifting of personnel is prohibited under no circumstances should this machine be used for lifting personnel." The lifting of personnel is also prohibited by the Association of Equipment Manufacturers' (AEM) Safety Manual for Operating and Maintenance Personnel Hydraulic Excavator which states, in pertinent part, "the hydraulic excavator is a one-person machine. NEVER PERMIT RIDERS."
