29 CFR 1910.119(h)(3)(ii): The contract employer did not assure that each contract employee was instructed in the known potential fire, explosion, or toxic release hazards related to his/her job and the process, and the applicable provisions of the emergency action plan:  Shambaugh & Son, L.P. worksite located at 253 Waggoner Boulevard, Toledo, OH 43612:  On or about April 13, 2023, and at times thereafter, the contract employer did not assure that each contract employee was instructed in the applicable provisions of the emergency action plan developed by Sofo Foods of Ohio, LLC for the worksite. This condition can result in fire and ammonia inhalation hazards to employees in the event of an ammonia release.

Shambaugh & Son, L.P. worksite located at 253 Waggoner Boulevard, Toledo, OH 43612:  On or about April 13, 2023, and at times thereafter, the contract employer did not document that each contract employee received and understood the training required by this paragraph for work performed at the aforementioned worksite, including training on the host site's emergency action plan.

29 CFR 1910.119(n): The employer did not establish an emergency plan for the entire plant in accordance with the provisions of 29 CFR 1910.38:  On or about April 13, 2023, and at times thereafter, the employer did not ensure the written emergency response plan contained all information required by 29 CFR 1910.38. The written plan did not include specific details on the procedures for reporting a fire or other emergency and procedures to be followed by employees who remain to operate critical plant operations before they evacuate with respect to employees performing work at host employer work locations. Failure to develop and implement a complete emergency action plan in accordance with 29 CFR 1910.38 can potentially expose employees to fire and inhalation hazards.
