OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not protected from struck-by hazards from pipes falling off a flatbed trailer.   Adjacent to Military Drive West and Creek Knoll: On or about April 15, 2023, and at times prior thereto, the employees were exposed to struck-by hazards while tasked to transport and unload steel pipes at their work area from a flatbed trailer which lacked safety devices such as steel stakes, chocks and binders.

29 CFR  1926.251(a)(6): Each day before being used, and during use, where service conditions warrant, the sling and all fastenings and attachments were not inspected for damage or defects by a competent person, and damaged or defective slings were not immediately removed from service:   a) Adjacent to Military Drive West and Creek Knoll: On or about April 15, 2023 and at times prior thereto employees were exposed to struck-by  hazards from falling pipe while utilizing a modified alloy steel chain which had two hooks removed from the coupling link and a nylon slings was put in the place of the two hook making it defective.   b)  Adjacent to Military Drive West and Creek Knoll: On or about April 15, 2023 and at times prior thereto employees were exposed to struck-by  hazards from falling pipe while utilizing a three inch polyester sling EET-2-93X, Ser#2033917-17, which showed signs of excessive wear, discoloration,  and fraying at the load bearing loops of the sling making it defective.

29 CFR  1926.251(b)(3): Job or shop hooks and links, or makeshift fasteners, formed from bolts, rods, or other such attachments shall not be used:  a) Adjacent to Military Drive West and Creek Knoll: On or about April 15, 2023, and at times prior thereto, employees were exposed to a struck-by hazard from falling pipe if the chain failed when using the in house made alloy steel chain sling whose tags did not match the chain.  b) Adjacent to Military Drive West and Creek Knoll: On or about April 15, 2023, and at times prior thereto, employees were exposed to a struck-by hazard from falling pipe if the chain failed when using slings created from alloy steel chain legs that had the hooks removed.

29 CFR  1926.251(e)(8): Synthetic web slings were not immediately removed from service if any of the following conditions specified in 1926.251(e)(8)(i) through (e)(8)(v) were present:  (i) Acid or caustic burns; (ii) Melting or charring of any part of the sling surface; (iii) snags, punctures, tears, or cuts; (iv) broken or worn stitches; or (v) distortion of fittings.  Adjacent to Military Drive West and Creek Knoll: On or about April 15, 2023 and at times prior thereto, employees were exposed to struck-by  hazards while utilizing defective slings for lifting pipes which showed signs of tears and broken stitches.
