29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms without being specifically designed by the manufacturer for such use: On or about April 14, 2023, on the SW corner of a newly built multi-family dwelling, where an employee was exposed to a fall hazard when elevated to a third floor wall opening in a wooden trash bin placed on the forks of a JLG Skytrak rough terrain forklift, Model 10054, that was not designed by the manufacturer for such use.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. On or about April 14, 2023, on the SW corner of a newly built multi-family dwelling where two workers completed work near a wall opening with a bottom edge less than 39 inches and 6 feet or more a lower level without a fall protection system.
