29 CFR  1910.1053(d)(1):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section:  (a)  11475 West 48th Avenue, Wheat Ridge, CO 80033: On or about April 18, 2023, and at times prior,  the employer did not perform initial assessment monitoring for exposure to respirable crystalline silica.  Employees are exposed to respirable crystalline silica while performing crushing operations.

29 CFR  1910.134(h)(2)(i):Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:  (a) 11475 West 48th Avenue, Wheat Ridge, CO 80033: On or about April 18, 2023, and at times prior,  respirators were not stored in a manner to protect them from contamination.  Employees wearing half-face Air Purifying Respirators stored the respirators with filters attached.  Storing the respirators in such a manner exposes them to contamination from the filters.

29 CFR  1910.1025(h)(1):All surfaces were not maintained as free as practicable of accumulations of lead:  (a)  11475 West 48th Avenue, Wheat Ridge, CO 80033: On or about April 18, 2023, and at times prior, surfaces were not maintained as free as practicable of accumulations of lead.  On May 5 2023, lead wipe sampling was conducted at Forte Analytical, LLC.  The wooden broom handle in the fire assay lab was wiped over an approximately 100 cm2 surface before and after cleaning with D-Wipe lead cleaning wipes.  Before cleaning, wipe sample results for the broom handle returned a result of 74.9 micrograms.  After cleaning with D-Wipes, wipe sample results for the broom handle returned a result of 74 micrograms.
